What Is Chapter 13 Bankruptcy?

Chapter 13 bankruptcy is commonly called the wage earner’s plan. This is because it allows individuals with regular incomes to repay some or all of their debts. More specifically, debtors propose a repayment plan to make installments to a bankruptcy trustee over 3-5 years. This trustee then distributes the payments to qualifying creditors.

If your current monthly income is greater than the applicable state median, your plan generally must be for 5 years. No Chapter 13 cases will last longer than 5 years.

  • Holding a form of regular, reliable income
  • Owing less than $419,275 in unsecured debt
  • Owing less than $1,257,850 in secured debt
  • Having current tax filings for the past four years

Importantly, unsecured debts are those that are not backed by collateral. These generally include debts from credit cards, taxes, medical bills, or personal loans. Secured debts are backed by collateral, including mortgages or car loans.
